This month we had the opportunity to speak with Gabriel Mondino, our Immigration Attorney at Burgos & Associates.  A graduate from Pace University, Gabriel has been a valued associate of the Burgos Law firm team since 2009 and recently he was named a Super Lawyer Rising star for his excellence in the area of business litigation. Gabriel has expertise in immigration, Employment / Workman’s Compensation, and business litigation. Read on to learn more about Gabriel in this month’s attorney spotlight:

Q & A WITH OUR IMMIGRATION ATTORNEY GABRIEL MONDINO

1. Your parents are from Argentina, you were born DC and attended Pace University in New York. How did you decide to settle in New Orleans?

Moved to New Orleans, LA after I got married to a woman from Lafayette LA

2. What do you enjoy most about the practice of law?

I enjoy being able to help people with issues they find too complex to address or which they are fearful to address themselves and being able to improve their lives once we have achieved the result they were looking for and improved their life.

3. What do you think are the biggest lessons of 2019 for Hispanics living in New Orleans?

The biggest lesson of 2019 is that the United States remains a land of opportunity and that the Hispanic community cannot operate by fear or be weakened by intimidation.   While individuals must be more aware of racist and discriminatory actions, there remain options in immigration, the justice system and laws of the United States still protect them. No dejes que nadie robe su paz.

4. Has the back and forth from the current Administration with regard to immigration affected your clients?

Tremendously.   The current administration is taking blatantly anti-immigrant, and inconsistent stances on a variety of issues, from making it more difficult for legal asylum seekers to obtain relief or have their claims heard, to removing discretion of immigration judges, to the handling of standard immigration applications.  While there hasn’t been a significant change in the actual immigration laws, the enforcement principals and fear promoted by this administration are having a very detrimental effect on immigrants to the United States.

5. What is the most challenging part of your work?

The fact that the legal and justice system can be difficult for people to understand, particularly if they feel that they have been wronged by it before and helping them feel comfortable with the fact that justice is a process that can be slow.

6. What is one of your proudest moment as an attorney at Burgos and Associates?

We were recently able to obtain a significant amount of unpaid overtime wages for a group of more than 40 individuals, who were mostly undocumented, from an employer that was notorious for its mistreatment of workers, including threats of “calling immigration” and other forms of intimidation.

7. What are your three most favorite activities outside of work?

Camping, enjoying restaurants and live music in the city of New Orleans, and participating in the day to day growth of my daughter.

8. What is something your clients would never guess about you?

My clients have been pretty creative, I’m not sure there is something that would surprise them once they know me.

9. Any words of advice for anyone looking for an immigration attorney in New Orleans?

Don’t be afraid of working with the detained docket.

3. ¿Cuál crees que es la lección más grande de 2019 para los hispanos que viven en Nueva Orleans?

La lección más importante de 2019 es que Estados Unidos sigue siendo una tierra de oportunidades, y que la comunidad hispana no puede operar por temor o ser debilitada por la intimidación. Si bien las personas deben ser más conscientes de las acciones racistas y discriminatorias, siempre existen opciones en el sistema inmigratorio, en el sistema de justicia y las leyes de los Estados Unidos que los protegen. Conozca sus derechos y no dejes que nadie robe su paz.

4. ¿El ir y venir de la Administración actual en relación con la inmigración afectó a sus clientes?

Tremendamente. La administración actual está tomando decisiones descaradamente antiinmigrantes e inconsistentes en una variedad de temas, desde hacer más difícil que los solicitantes de asilo legales obtengan alivio o que sus reclamos sean escuchados, hasta eliminar la discreción de los jueces de inmigración, hasta el manejo de muchas aplicaciones migratorias. Si bien no ha habido un cambio significativo en las leyes de inmigración actuales, los directores de cumplimiento y el temor promovido por esta administración están teniendo un efecto muy perjudicial en los inmigrantes a los Estados Unidos.

5. ¿Cuál es la parte más desafiante de tu trabajo?

El hecho de que el sistema legal y de justicia puede ser difícil de entender para las personas, especialmente si sienten que se les ha hecho daño antes y les ayuda a sentirse cómodos con el hecho de que la justicia es un proceso que puede ser lento.

6. ¿Cuál es uno de sus momentos de mayor orgullo como abogado en Burgos y Asociados?

Recientemente pudimos obtener una cantidad significativa de salarios no pagados de tiempo extra para un grupo de más de 40 personas, en su mayoría indocumentadas, de un empleador que era conocido por su maltrato a los trabajadores, incluidas las amenazas de “inmigración” y otras formas de intimidación.

7. ¿Cuáles son tus tres actividades favoritas fuera del trabajo?

Acampar, disfrutar de restaurantes y música en vivo en la ciudad de Nueva Orleans y participar en el crecimiento diario de mi hija.

8. ¿Qué es algo que tus clientes nunca adivinarían sobre ti?

Mis clientes han sido bastante creativos, no estoy seguro de que haya algo que los sorprenda una vez que me conozcan.
